1. Acceptance of Terms

By accessing or using the Fold Home application, the Fold Fabric application, or any related services (collectively, the “Services”) provided by Fold Home, LLC (“Fold,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Services.

2. Description of Services

Fold provides smart home automation software, including the Fold Home iOS application for device control and the Fold Fabric macOS application for system configuration. The Services enable users to manage, automate, and interact with compatible smart home devices and platforms.

3. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. By using the Services, you represent and warrant that you meet these requirements.

4. Account Registration

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations.
  • Reverse engineer, decompile, or disassemble any part of the Services.
  • Attempt to gain unauthorized access to any systems or networks connected to the Services.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Use the Services to control devices in a manner that could cause harm to persons or property.

6. Intellectual Property

All content, features, and functionality of the Services, including but not limited to software, text, graphics, logos, and designs, are owned by Fold Home, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

7. Third-Party Integrations

The Services may integrate with third-party smart home platforms, devices, and services. We are not responsible for the availability, functionality, or security of any third-party products or services. Your use of third-party integrations is subject to their respective terms and policies.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOLD HOME, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROPERTY DAMAGE, PERSONAL INJURY, OR LOSS OF PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

10. Indemnification

You agree to indemnify and hold harmless Fold Home, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Services or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date. Your continued use of the Services after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
